Are you already in compliance with France’s new property declaration requirement?

Do you own real estate in France – either directly or indirectly? Thanks to new French legislation, all property owners are subject to a new declaration requirement which must be met by 30 June 2023.

What is the reason for the new legislation?

From 2023, French property that serves as the owner’s main residence is no longer subject to French property tax or ‘taxe d’habitation’. However, this tax does remain applicable for all other French real estate, such as holiday homes or properties let to third parties. The French tax authorities have imposed a new reporting obligation on homeowners to enable them to track the use of the properties in question.

Who must file a declaration?

Filing a declaration is mandatory for all owners of residential property. Such owners can be a natural person or legal entity. French SCIs are therefore also required to file a declaration. The law does not make any distinction based on the owner’s tax residency: the reporting obligation applies to both residents and non-residents of France.

When must the declaration be filed?

The final declaration date is 30 June 2023. 

There is no annual declaration obligation. However, if the information provided in the first/previous declaration is no longer up to date, a new declaration will need to be filed.

How should the declaration be filed?

The declaration must be filed digitally on the website of the French tax authorities.
